QRius Pay Inc. its affiliates and subsidiaries (collectively “QRius Pay”, “we” and “us”) respect your privacy. We offer services that enable merchants (including Charities and Nonprofits) to run operations and to safely conduct digital payment transactions. This Privacy Policy describes the types of Personal Data we collect through our payment products and services (“Services”) via our online presence, which include our main website at qriuspay.com, as well as services and websites that we enable Internet users to access, such as Nonprofit portal, Customer login, QRius Pay QR Codes, and the QRius Shop (collectively, our “Sites”). This policy also describes how we use Personal Data, with whom we share it, your rights, and choices, and how you can contact us about our privacy practices. This policy does not apply to third-party websites (such as Stripe, Elavon or Merchant Brokers), products, or services, even if they link to our Services or Sites, and you should consider the privacy practices of those third parties carefully.

How we define Personal Data: Personal Data is information that can identify you, as an individual. This information includes your name, home address, home phone number, gender, date of birth, language preference, email address, credit card information, bank account information, account information with us, IP address or social media username or identification.

Information about your organization’s title, address, telephone number, email address or fax number is not personal information.

1. Overview
QRius Pay obtains Personal Data about you from various sources to provide our Services and to manage our Sites. “You” may be a visitor to one of our websites, a user of one or more of our Services (“Client” or “QRius Pay Client”), or a customer of a Client (“End User”).

Note: Any financial information including payment method information (such as credit or debit card number, or bank account information), purchase amount, date of purchase, and payment method is not collected or stored with QRius Pay Inc. We utilize Stripe, Elavon and Merchant Brokers for their merchant and payment processing services. Please refer to the following privacy policies for further information.

2. What Data is Collected

(a) Personal Data that we collect about you.

The Personal Data that you provide directly to us through our Sites and Services will be apparent from the context in which you provide the data. In particular:

When you fill-in our online form to contact our sales team, we collect your full name, email and anything else you tell us about your project, needs and timeline.

When you respond to QRius Pay emails or surveys we collect your email address, name and any other information you choose to include in the body of your email or responses.

If you are a QRius Pay Client, we may collect your contact details, such as name, mailing address, telephone number, and email address. As part of your business relationship with us, you will also provide us Business information such as Nonprofit Name, Address, and Postal/ZIP Code.

If you are a Customer of a QRius Pay Client, when you make payments / donations or conduct transactions through a QRius Pay website, you may provide us personal information such as First Name, Last Name, Address and Email Address.

If you apply for a job with us, we will collect the information you include in your job application, including your cover letter, resume.

You may also choose to submit information to us via other methods, including: (i) in response to marketing or other communications, (ii) through social media or online forums, (iii) through participation in an offer, program or promotion, (iv) in connection with an actual or potential business relationship with us, or (v) by giving us your business card or contact details at trade shows or other events.

(b) Information that we collect automatically on our Sites.
Our Sites use cookies and other technologies to function effectively. These technologies record information about your use of our Sites, including:

Electronic information, such as web browser and device characteristics.

Online identifiers (e.g., information you use to log in to your account), Internet Protocol (“IP”) address, and unique personal identifiers (including device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology; customer number; unique alias, and other identifiers);

Internet or other electronic network activity information, which includes information about how you use and interact with our Services, including your access time, “log-in” and “log-out” information, browser type and language, the domain name of your internet service provider, other attributes about your browser, any specific page you visit on our platform, content you view, features you use, the date and time of your use of the Services, your search terms, and the website you visited before you visited or used the Services.

Inferences drawn from any of the information above to create a profile about you that may reflect, for example, your preferences, characteristics, and behavior, including for account security purposes or to enhance our services to you.

We also collect information about your online activities on websites and connected devices over time and across third-party websites, devices, apps and other online features and services. We use Google Analytics on our Sites to help us analyze Your use of our Sites and diagnose technical issues.

3. How We Use Personal Data

(a) Our products and services.
We use Personal Data to facilitate the business relationships we have with our Users, to comply with our financial regulatory and other legal obligations, and to pursue our legitimate business interests. We also collect Personal Data to tax receipts to our end users.

(b) Marketing and events-related communications.
We may send you email marketing communications about QRius Pay products and services, invite you to participate in our events or surveys, or otherwise communicate with you for marketing purposes, provided that we do so in accordance with the consent requirements that are imposed by applicable law. For example, when we collect your business contact details through our participation at trade shows or other events, we may use the information to follow-up with you regarding an event, send you information that you have requested on our products and services and, with your permission, include you on our marketing information campaigns.

(c) Advertising.
We do not use, share, rent or sell the Personal Data of our Users’ Customers for interest-based advertising. We do not sell or rent the Personal Data of our Users, their Customers or our Site visitors.

4. Sources of Information
We collect your information from you and the other sources listed below.

· You directly, when you submit information to us or allow us to access information about you;

· Your devices and applications when you interact with our website or use our Services;

· From our payment processing and merchant services provider: Stripe, Elavon and Merchant Brokers

5. When and with whom we share Personal information.
QRius Pay does not sell or rent Personal Data to marketers or unaffiliated third parties. We share your Personal Data with trusted entities, as outlined below.

(a) QRius Pay. We share Personal Data with other QRius Pay entities in order to provide our Services and for internal administration purposes.

(b) Service providers. We share Personal Data with a limited number of our service providers. We have service providers that provide services on our behalf, such as website hosting, data analysis, information technology and related infrastructure, customer service, email delivery, and auditing services. These service providers may need to access Personal Data to perform their services. We authorize such service providers to use or disclose the Personal Data only as necessary to perform services on our behalf or comply with legal requirements.

(c) Safety and Compliance with Law If we believe that disclosure is reasonably necessary (i) to comply with any applicable law, regulation, legal process or governmental request (e.g., from creditors, tax authorities, law enforcement agencies, in response to a garnishment, levy, or lien notice, etc.); (ii) to establish, exercise or defend our legal rights; (iii) to enforce or comply with our General Terms or other applicable agreements or policies; (iv) to protect our or our customers’ rights or property, or the security or integrity of our Services; (v) for an investigation of suspected or actual illegal activity; or (vi) to protect us, users of our Services or the public from harm, fraud, or potentially prohibited or illegal activities.

(d) With Your Consent: With your consent. For example: At your direction or as described at the time you agree to share; or when you authorize a third-party application or website to access your information.

6. Your Choices.
You have choices regarding our use and disclosure of your Personal Data:

(a) You can opt out of receiving promotional messages from QRius Pay by following the instructions in those messages or by informing the caller that you would not like to receive future promotional calls. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages that are required to provide you with our Services.

(b) You can review, correct, or update Personal Data that You have previously disclosed to us, you may do so by signing in to your QRius Pay account or by emailing us at [email protected]

(c) Your data protection rights. Depending on your location and subject to applicable law, you may have the following rights with regard to the Personal Data we control about you:

i. The right to request confirmation of whether QRius Pay processes Personal Data relating to you, and if so, to request a copy of that Personal Data;

ii. The right to request that QRius Pay rectifies or updates your Personal Data that is inaccurate, incomplete or outdated;

iii. The right to request that QRius Pay erase your Personal Data in certain circumstances provided by law;

iv. The right to request that QRius Pay restrict the use of your Personal Data

(d) If you wish to deactivate your account or exercise any data protection rights, you can do so by emailing us at [email protected]. We take each request seriously. We will comply with your request to the extent required by applicable law.
For your protection, we may need to verify your identity before responding to your request, such as verifying that the email address from which you send the request matches your email address that we have on file

7. Security, Storage and Retention.
We take reasonable measures, including administrative, technical, and physical safeguards, to protect your information from loss, theft, and misuse, and unauthorized access, disclosure, alteration, and destruction. Nevertheless, the internet is not a 100% secure environment, and we cannot guarantee absolute security of the transmission or storage of your information.

We hold information about you both at our own premises and with the assistance of third-party service providers. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please contact us immediately at [email protected]

We may, and we may use third-party service providers to, process and store your information in the United States, Canada, and other countries.

We will retain your personal information for as long as is necessary in order to manage our relationship with you, fulfill the purposes for which it was collected or as necessary or as permitted or required by law. At the end of this period, your personal information will either be deleted or anonymized. We also retain Personal Data to comply with our tax, accounting, and financial reporting obligations and where data retention is mandated by the payment methods that we support. Where we retain data, we do so in accordance with any limitation periods and records retention obligations that are imposed by applicable law.

8. International Data Transfers.
We are a global business. Personal Data may be stored and processed in any country where we have operations or where we engage service providers.

9. Use by Minors.
Our Services are general audience services not directed at children under the age of 18. If we learn that any information we collect has been provided by a child under the age of 18, we will promptly delete that information.

10. Updates To this Privacy Policy and Notifications.
We may amend this Privacy Notice from time to time by posting a revised version and updating the “Effective Date” above. The revised version will be effective on the “Effective Date” listed. We will provide you with reasonable prior notice of material changes in how we use your information, including by email if you have provided one. If you disagree with these changes, you may cancel your account at any time. If you keep using our Services, you consent to any amendment of this Privacy Notice.

11. Links to Other Websites.
The Services may provide the ability to connect to other websites (Such as Stripe, Elavon or Merchant Brokers). These websites operate independently from us and may have their own privacy notices or policies, which we strongly suggest you review. If any linked website is not owned or controlled by us, we are not responsible for its content, any use of the website or the privacy practices of the operator of the website.

12. Jurisdiction-specific Provisions.
United states: This section provides additional details about the personal information we collect about California consumers as well as the rights of California consumers under the California Consumer Privacy Act (CCPA). Even though you use our services while acting as an employee, owner, director, officer, or contractor of a company, partnership, sole proprietor of a business, nonprofit, or government agency, if you live in California, California law gives you the right to ask if we disclose your personal information to third parties for their direct marketing purposes (we do not disclose your personal information for others’ direct marketing purposes). It also gives you the right to ask if we sell your personal information to third parties (we do not sell your personal information and have not done so in the past), and if we did (which we don’t), you’d have the right to opt out of such sales.
